Frequently Asked Questions about the New CARB Regulation

What is CARB? The California Air Resources Board (CARB) is part of the California Environmental Protection Agency, which reports directly to the governor’s office in California. Their mission is to promote and protect public health, welfare and ecological resources through the effective and efficient reduction of air pollutants.

What are the compliance standards? By January 1, 2010, CARB mandates a 50% reduction in diesel particulate matter emitted from 2001 and older transport refrigeration unit (TRU) diesel model year engines. At the end of 2009, all 2002 model year engines must comply.

Who must comply? CARB mandates that all refrigerated trailers operating in or entering California must comply, regardless of state or country of origin.

What happens if I get caught with a non-compliant reefer? CARB may assess fines of $1,000 and up to $50,000 per day and/ or one year in jail.

We only operate our one refrigeration unit once or twice a month for a few hours. Must we upgrade the unit even with for a few hours per month? CARB does not have a low use exemption option. ALL California TRUs in operable condition must apply for IDNs and be compliant.

I heard that if I licensed my trailer out of state, or in Mexico, it would be considered an out-of-state vehicle and I could come into California with no problems from CARB. Compliance is required for all refrigerated trailers entering California, regardless of state of country or origin.

Aren't they just going after the large fleets? Compliance inspections can be anywhere TRUs operate, including border crossings, scales, roadside terminals, distribution centers and delivery points.

Do you really think they are going to enforce it? The ARB is committed to protecting the public health and plan to aggressively enforce the regulation. Enforcement on facilities has already begun with some fines already being issued.  

Can I still sell a used refrigerated trailer in California after the compliance deadline has passed? It is illegal to sell, offer for sale, offer to lease, rent or offer to rent a TRU in California that does not meet the in-use performance standards in the Airborne Toxic Control Measure (ATCM). It is therefore no longer CARB compliant. Violations of these prohibitions are subject to fines up to $35,000 per day per violation.
