This XTRA Website Privacy Policy is effective on August 31, 2005.

This XTRA Website Privacy Policy tells you what information XTRA Corporation and/or its affiliated companies (collectively, "XTRA") may collect in connection with your use of www.xtra.com, www.xtralease.com, www.xtratrack.com, www.xtrainstall.com, and www.myqualcomm.com(collectively, the "XTRA Websites"). It also tells you how XTRA may use such information.

1. Information About Users XTRA Gathers

The information we gather from users helps us customize and continually improve our XTRA Websites and your experience using the XTRA Websites. We gather information from you when you visit the XTRA Websites. Our information gathering activities include, but are not limited to the following:

(i)Information You Give Us.

We receive and store any information you enter in your member registration form or give us in any other way, such as your name, address, phone number, or e-mail address. Information that you provide is used to customize future services for you, to communicate with you regarding the XTRA Websites and our business, and to help us operate the XTRA Websites effectively. You may opt out of receiving promotions from XTRA based on this information by utilizing the opt out feature in the Member Profile Section of the xtralease.com web site.

(ii)Automatic Information

We receive and store certain types of “automatic information” whenever you interact with us. “Automatic information” is information automatically collected by our web server (which may be hosted by a third-party) that your web browser makes available whenever you visit the XTRA Websites. This information may include your Internet Protocol address, the identity of your internet service provider, the type of browser that you use, and the date and time of your visit. An Internet Protocol address is a number assigned to your computer when you connect to the Internet.

The XTRA Websites also use “cookies.” A “cookie” is a small amount of data that is sent to your computer from a web server and stored on your computer's hard drive. When you initially visit an XTRA Website, a “cookie” is sent to your computer that uniquely identifies your browser. The cookie is read by us each time you visit an XTRA Website. Most browsers are initially set up to accept cookies. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, if your browser is set to refuse cookies, the XTRA Websites may not work through your Web browser.

2. Links

There are links to other Websites from the pages of the XTRA Websites that take you outside of the XTRA Websites. These policies have no application once you have left the XTRA Websites, and other Websites may send their own cookies to users, collect data, or solicit personal information.

3. Aggregate Information

XTRA may combine the information you provide along with the statistics of your use on the XTRA Websites, including what you view, with information derived from other users to create "aggregate data" that we use internally. This data is also used to operate the XTRA Websites and to customize the XTRA Websites to deliver a better experience for our users.

4. Quality Assurance/Legal Compliance

XTRA may record and reproduce information you provide and records created by your use of the XTRA Websites for quality assurance and technical assistance purposes or for verifying a user's compliance with this Agreement or the law.

5. When XTRA Uses and Shares Information It Receives

We are not in the business of selling user information to others. We do use and share user information, however, in connection with the ordinary operation of our business as described below.

(i)Purposes of Communication

XTRA may use the information we receive for the purpose of communicating with users/potential users and providing them with information about the products and services we offer. For example, the automatic information that we collect from you (such as your Internet Protocol address) may be used to send you or your organization information regarding various XTRA products and/or services.

(ii) Service and Product Providers

We contract with other product service providers to perform some of the functions relating to the XTRA Websites on our behalf and to provide you some of the goods and services offered through XTRA's business. Our providers will have access to member information only to the extent that it assists them in performing their functions for our users and customers. The ways in which we share information include, but are not limited to, the following:

(a) Business Transactions

As XTRA grows its business, XTRA might sell or buy assets. In such transactions, user information generally is one of the transferred assets. Also, should XTRA sell substantially all of its assets or need to liquidate its assets in connection with bankruptcy, information collected from the XTRA Websites will be one of the assets transferred.

(b)Protection of XTRA and Others

We disclose user information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) XTRA's rights or property, other users, or anyone else that could be harmed by such activities. XTRA may disclose user information when we believe in good faith that the law requires it.

6. Changes to this Privacy Policy

We reserve the right to revise this Privacy Policy at any time. When we do, we will give you notice of the revised Privacy Policy by posting the revised Privacy Policy on the XTRA Websites and by revising the "effective date” at the top of this Privacy Policy. You are responsible for regularly reviewing the current Privacy Policy.

7. Security of My Information

Information transmitted on the Internet and/or stored on systems connected to the Internet is not 100% secure. As a result, we do not ensure, warrant or guarantee the security or integrity of any information transmitted to us over the Internet or stored on our systems.

8. How You Can Remove Information

You may request that we delete any personal information we may have collected about your (address, phone number, e-mail address or other registration information, etc.) from our computers by contacting us directly using the customer service link on the XTRA Websites or by contacting customerservice@xtra.com.
